Terms and Conditions

The rules that govern how you use Orderzy, whether you are a diner or a restaurant.

1. Who Orderzy is

Orderzy is a dine-in ordering platform used by restaurants, cafes, bars, and hotel restaurants in India. Orderzy is not a restaurant. Orderzy does not prepare or serve food. Orderzy provides software that helps a diner place an order at the table and helps a restaurant receive, prepare, bill, and settle that order. Payments on Orderzy are processed by Cashfree Payments, a licensed payment aggregator authorised by the Reserve Bank of India.

2. Two audiences, one platform

Orderzy is a two-sided marketplace. These terms apply to both sides.

  • Diners use Orderzy to browse a restaurant's menu, place an order at the table, and settle the bill.
  • Restaurants use Orderzy to receive orders in the kitchen, manage the running tab of a dining session, and settle payments.

By using Orderzy, you agree to these terms whether you sign up for an account or use the platform as a guest.

3. Account registration

  • Accurate information. When you create an account or list a restaurant, the information you provide must be true, current, and complete.
  • Account security. You are responsible for the safety of your login credentials. Notify us right away if you notice unauthorised access.
  • Age. You must be at least 18 years of age to place an order that involves a payment. Diners under 18 may use the platform only under the supervision of a parent or guardian who accepts these terms on their behalf.
  • Restaurant onboarding. A restaurant listing goes live after Orderzy verifies the identity of the owner and the operating address of the outlet.

4. How orders and payments work

  • Menu and prices. Menu items and prices are set by the restaurant and displayed on the diner's phone at the time of ordering. The restaurant is responsible for keeping menu, allergens, and prices accurate. Orderzy is not liable for menu or price errors made by the restaurant.
  • Order acceptance. An order is accepted only when the restaurant marks it accepted in the kitchen queue. Before that point, either side may cancel without cost.
  • Payment aggregator. Payments are processed by Cashfree Payments. Card details, UPI IDs, and other payment credentials never touch Orderzy servers. Cashfree's terms govern the payment leg.
  • Platform fee. A small platform fee, sized to the order and disclosed on the checkout screen, is charged to the diner. The platform fee is Orderzy's revenue for the transaction. It is separate from the restaurant's food charge.
  • Taxes. Applicable taxes are added to the bill per current Indian tax law. The restaurant is responsible for tax registration and filing on its own revenue.
  • Payouts to restaurants. Restaurant payouts settle to the bank account named by the restaurant during onboarding, per the Cashfree payout schedule.

5. What you must not do

  • Use Orderzy for anything unlawful, or in violation of Indian law.
  • Attempt to access, scrape, or reverse-engineer parts of the platform you are not authorised to see.
  • Upload content (photos, reviews, menu items) that infringes another party's rights or misleads other users.
  • Impersonate a restaurant, an owner, or another diner.
  • Use the platform to send unsolicited communication to diners or restaurants.

6. Content on Orderzy

  • Platform content. The Orderzy name, logo, product design, and code belong to Orderzy. You are granted a limited, non-transferable, revocable licence to use the platform for its intended purpose.
  • Restaurant content. A restaurant retains ownership of the menu, food photos, and descriptions it uploads. By uploading, the restaurant grants Orderzy a licence to display that content on the platform for the purpose of running the marketplace.
  • Diner content. A diner retains ownership of reviews, ratings, and any content they submit. By submitting, the diner grants Orderzy a licence to display that content on the platform.

7. Refunds and cancellations

Our refund and cancellation policy is a separate document. Read it at /refund-policy/. It forms part of these terms.

8. Privacy and personal data

How Orderzy handles personal data is covered in our Privacy Policy at /privacy-policy/. The Privacy Policy is written to the Digital Personal Data Protection Act, 2023, and forms part of these terms.

9. Third-party services

Orderzy relies on third-party services to run the platform. Named sub-processors include Cashfree Payments (payment processing), DigitalOcean (hosting), Meta (WhatsApp Business messaging for bill delivery and reservation reminders), Google (Maps for reverse-geocode of the diner's approximate location on the home page). Their terms apply to the parts of the service they provide.

10. Limitation of liability

Orderzy provides the software layer. Food quality, hygiene, allergens, timing, and in-restaurant experience are the restaurant's responsibility. Orderzy's liability, in the aggregate, is limited to the platform fee actually paid by the diner or the restaurant in the 30 days before the claim. Orderzy is not liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the platform.

11. Indemnification

You agree to hold Orderzy, its founder, and its affiliates harmless from any claim that arises from your misuse of the platform or from your breach of these terms.

12. Termination

Either side may stop using Orderzy at any time. Orderzy may suspend or terminate an account that violates these terms, misrepresents itself, or engages in conduct that harms other users.

13. Governing law and dispute resolution

These terms are governed by the laws of India. Any dispute that is not resolved through the grievance process below will be resolved by binding arbitration in Bhopal, Madhya Pradesh, under the Arbitration and Conciliation Act, 1996.

14. Grievance Officer

Under IT Rules 2011 and the Digital Personal Data Protection Act, 2023, Orderzy names the following Grievance Officer.

15. Changes to these terms

Orderzy may update these terms as the product evolves. Material changes will be reflected in the "last updated" date at the top of this page. Continued use of the platform after a change means acceptance of the updated terms.
